Affiliate Agreement
VitaFit Performance Affiliate Agreement

This Agreement is entered into by and between VitaFit Performance, a brand operated under XXII DRIVE LLC (“Company”), and _____________________________ (“Affiliate”).
1. Program Overview
- Affiliate agrees to promote VitaFit Performance products through personal networks, digital content, and other appropriate platforms in exchange for commission on referred sales.
2. Commission Structure
- Affiliate will receive 20% commission on the subtotal of each qualifying sale.
- Commissions are tracked via unique referral links and/or discount codes.
- Payouts are issued monthly via PayPal or bank transfer, on the last business day of each month, provided Affiliate has earned a minimum of $25 in commissions.
3. Product Use & Promotion
- Affiliate agrees to honestly represent VitaFit Performance products and not make false claims.
- The Company may provide complimentary products or discount codes for promotional use.
- All content must comply with FTC guidelines for affiliate disclosure (e.g., “#ad” or “#sponsored”).
4. Content Visibility Requirements
- Affiliate agrees to keep promotional content (feed posts, Reels, TikToks) live for a minimum of 7 days unless otherwise approved in writing.
- Story posts must remain live for a full 24-hour cycle and not be deleted prematurely.
- VitaFit Performance may request reposting or grant additional usage rights for select content with credit to the creator. Content may be used by VitaFit Performance for marketing purposes, including reposting, paid ads, or web features, with credit given to the creator.
5. Term & Termination
- This Agreement will remain in effect until terminated by either party with written notice.
- The Company reserves the right to terminate this agreement at any time for breach of terms or misuse of materials.
6. Brand Integrity
- Affiliates may not promote VitaFit Performance alongside competing brands or use inappropriate or misleading marketing tactics.
- Brand assets (logos, photos, etc.) must be used as provided without modification unless approved in writing.
7. Modifications
- VitaFit Performance reserves the right to update this agreement at any time, with notice to the affiliate.
8. Legal
- This Agreement is governed by the laws of the State of California. - Affiliate is considered an independent contractor, not an employee.
